Municipalities cannot create special ISS regimes for law firms nor legislate on the tax calculation basis. The thesis was established by the Federal Supreme Court to declare unconstitutional the Porto Alegre law that created a different regime for lawyers to pay ISS: instead of paying a fixed rate, as required by federal legislation on the subject, they would pay a percentage on top of the price of the service they provided.
